Terms of service
Effective Oct 7, 2026 · Zachary Jude LLC
1. Agreement to These Terms
These Terms of Service govern your use of zacharyjude.com and any purchase, commission, repair, or other service from Zachary Jude LLC ("Zachary Jude," "we," "us," or "our"). By using this site, submitting an inquiry, approving a design, paying a deposit, or placing an order, you agree to these terms. If you do not agree, please do not use the site or our services.
You must be at least 18 years old, or the age of majority where you live, to place an order or commission.
2. Use of the Site
You may use this site for personal, non-commercial purposes only. You agree not to misuse the site, interfere with its operation, copy or scrape its content, attempt to access it by unauthorized means, or use it for any unlawful purpose. We may refuse service, cancel orders, or restrict access to the site at our discretion.
3. Products and Descriptions
We work with both natural and lab-grown diamonds, and every piece is clearly identified as one or the other. Center diamonds of one carat and above are accompanied by a GIA grading report. Many colored gemstones are routinely treated to enhance their appearance; we disclose any treatment known to us.
We make every effort to describe and photograph our pieces accurately. Because fine jewelry is made by hand and every stone is unique, slight variations in color, size, weight, and finish may occur, and screens may display colors differently. These variations are not defects. All weights and measurements are approximate unless stated on a grading report.
Any appraisal or valuation we provide is for insurance purposes only and does not reflect resale value.
4. Orders and Verification
Your order is an offer to purchase and is not accepted until we confirm it in writing. We may decline or cancel any order at our discretion, including if we suspect fraud or cannot verify payment, with a full refund of any amount paid. For high-value orders, we may ask you to verify your identity and billing details before an order is accepted or shipped.
5. Commissions and Bespoke Orders
Bespoke pieces and engagement rings are made to order. Each commission follows these stages:
- Consultation. We discuss your ideas, budget, and timeline.
- Design. We prepare sketches, renderings, or CAD for your review. The design moves forward only once you approve it in writing. Approval by email or text message counts as written approval.
- Materials and quote. Metals and any stones are selected, and we provide a final written quote.
- Deposit. Production begins once we receive a non-refundable deposit of 65% of the quoted price. The deposit covers design work, stone sourcing, and materials purchased for your piece.
- Completion. The remaining balance is due before your piece is shipped or collected.
Changes. Changes requested after design approval may affect the price and timeline and will be confirmed in writing before work continues.
Cancellations. You may cancel at no cost before paying your deposit. Once the deposit is paid, it is non-refundable. If you cancel after production has begun, you remain responsible for any costs incurred beyond the deposit, including stones purchased for your piece. Completed bespoke pieces and engagement rings are final sale and cannot be returned or exchanged.
Timelines. Timelines are estimates confirmed at the time of your deposit. Stone sourcing, design changes, and production can affect delivery dates, and we will keep you informed of any delay. Because we cannot guarantee delivery by a specific date, we are not responsible for any event, proposal, or occasion planned around an estimated date.
Unpaid balances. We will notify you when your piece is complete. If the remaining balance is not paid within 30 days of that notice, we may hold your piece until payment is received. If the balance remains unpaid 90 days after that notice, and after one final written reminder, the piece will be considered abandoned: we may retain your deposit, keep or resell the piece, and reuse its materials, with no further obligation to you.
Sizing. We will make your piece to the size you provide. Resizing after completion is offered for a fee where the design allows; some designs, including eternity and fully set bands, cannot be resized.
Client-supplied stones and metal. We are happy to reset stones or rework metal you provide. By supplying them, you confirm that you own them and have the right to have them worked on. Each stone is examined before work begins, and we will let you know if we see any risk, but we do not grade, appraise, or authenticate client-supplied materials unless agreed in writing. Because stones can chip, crack, or break during setting, sizing, or repair even with every care taken, client-supplied materials are worked on at the owner's risk, and Zachary Jude is not liable for damage to or loss of them. We recommend insuring them before work begins.
6. Pricing and Payment
All prices are in US dollars. Prices for commissions are confirmed in your written quote. Because the cost of gold, platinum, and stones can change, quotes are valid for 14 days.
We reserve the right to correct any pricing or typographical errors and to cancel orders placed at an incorrect price, with a full refund of any amount paid. Applicable sales tax will be added where required. Payment must be received in full before an order ships or is collected.
Payment disputes. Before disputing any charge with your bank or card issuer, you agree to contact us first so we can resolve the matter directly. Your written design approval, quote, and signed proof of delivery confirm your order, and we will provide them to your card issuer in response to any dispute.
7. Shipping, Collection, and Risk of Loss
Every piece ships fully insured, and a signature is required upon delivery. Risk of loss passes to you once your order has been delivered and signed for, or collected in person. Please ensure your shipping address is correct; we are not responsible for delays or losses caused by an incorrect address you provided.
Please inspect your piece upon delivery and contact us within 48 hours of delivery with any concern about its condition.
International orders ship Delivery Duty Unpaid (DDU), and any customs duties, taxes, or fees are the responsibility of the recipient. Full details are in our Shipping policy.
8. Returns and Exchanges
Commissions, including bespoke pieces and engagement rings, are final sale. Eligible ready-to-ship pieces may be returned for store credit as described in our Returns and Exchanges policy, which forms part of these terms.
9. Care, Wear, and Repairs
Fine jewelry should be cared for as described in our care guidance. We are not responsible for damage caused by normal wear, accidents, impact, improper care, loss of stones resulting from impact or wear, or any repair, resizing, or alteration performed by anyone other than Zachary Jude. Any work by another jeweler may affect our ability to service your piece. Repairs and servicing are available at our standard rates.
10. Intellectual Property and Designs
All content on this site, including designs, images, text, logos, and the Zachary Jude name, belongs to Zachary Jude and is protected by copyright and trademark law. You may not copy, reproduce, or use it without our written permission.
When you commission a piece, you own the finished piece. Zachary Jude retains all rights to the design, including sketches, renderings, and CAD files, and may reproduce, adapt, or offer the design or similar designs in the future. You may not reproduce the design, or have it reproduced by another jeweler, without our written permission.
By sharing images or references with us, you confirm you have the right to share them. We create original designs and may decline any request to copy a design protected by another brand.
11. Privacy, Discretion, and Photography
We treat every commission with discretion. Images, references, and ideas you share with us are used only to design your piece. Unless you ask us in writing not to before your piece is completed, we may photograph finished pieces and share them, without identifying you, on our site and social channels.
Your use of this site is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
12. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THIS SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT AS EXPRESSLY STATED IN WRITING BY ZACHARY JUDE. We do not guarantee that the site will be uninterrupted or error free.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ZACHARY JUDE AND ITS OWNERS, EMPLOYEES, AND PARTNERS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS OR EMOTIONAL DISTRESS, ARISING FROM YOUR USE OF THE SITE OR OUR PRODUCTS OR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE IN QUESTION.
14. Indemnification
You agree to indemnify and hold harmless Zachary Jude and its owners, employees, and partners from any claims, losses, or expenses, including reasonable attorneys' fees, arising from your misuse of the site, your violation of these terms, or any materials or information you provide to us.
15. Events Beyond Our Control
We are not responsible for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, severe weather, supplier or carrier delays, government action, labor disputes, pandemics, or disruptions to utilities or the internet.
16. Disputes and Governing Law
If a concern arises, please contact us first; we will work in good faith to resolve it within 30 days. These terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute will be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction. To the fullest extent permitted by law, any claim must be brought individually and not as part of a class or representative action, and you and Zachary Jude each waive the right to a jury trial. In any legal action to enforce these terms, the prevailing party is entitled to recover its reasonable attorneys' fees and costs.
17. Relationship with Shopify
Our store is powered by Shopify. All sales are made directly with Zachary Jude, and Shopify is not responsible for any aspect of your purchase.
18. General
Termination. We may suspend or end your access to the site at any time if you violate these terms. Sections that by their nature should survive, including those on intellectual property, payment, liability, and disputes, will continue to apply.
Severability. If any part of these terms is found unenforceable, it will be enforced to the fullest extent permitted, and the rest of these terms remain in full effect.
Entire agreement. These terms, together with our policies and any written quote or commission agreement, are the entire agreement between you and Zachary Jude. If a written quote or commission agreement conflicts with these terms, the quote or agreement controls for that order. Our failure to enforce any provision is not a waiver of it.
Assignment. You may not transfer your rights under these terms without our written consent. We may transfer our rights and obligations, including in connection with a sale, merger, or reorganization of our business.
19. Changes to These Terms
We may update these terms from time to time. Changes take effect when posted on this page, and the date at the top will reflect the latest version. Orders and commissions are governed by the terms in effect when your order was accepted or your deposit was paid.
